If this fence is going around a pool, the design has to follow safety code, not just Thornton’s general height rules. The widely adopted standard calls for no more than a 4-inch gap between pickets, a minimum height of 48 inches, and a self-closing, self-latching gate with the latch at least 54 inches off the ground.
